BENIHANA MEMORIES CONTEST - OFFICIAL RULES

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT IMPROVE YOUR CHANCES OF WINNING.
1. ELIGIBILITY: Open only to legal residents of the United States, who are 13 years of age or older as of date of entry. Void wherever prohibited by law. Employees, officers and directors of Benihana National Corp. (“Sponsor”), their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and the immediate family members (parents, children, siblings, spouse) and/or those living in the same household of each (whether related or not) are not eligible. By participating, entrants agree to be bound by the Official Rules and the decisions of the judges.
HOW TO ENTER: Beginning 12:01 AM Eastern Time on June 1, 2009, go to www.benihana.com, click the Benihana Memories button and follow the on-screen instructions to enter.
2. No mechanically reproduced entries of any kind permitted. Illegible and incomplete entries are void. Sponsor is not responsible for lost, late, mutilated, invalid, unintelligible, technically corrupted, garbled, or misdirected entries or entries not received. In the event of a dispute over who submitted an online entry, the entry will be deemed to have been submitted by the authorized account holder of the e-mail account identified on the online entry form. The authorized account holder is deemed to be the natural person who is assigned to an e-mail address by an Internet access provider, service provider, or online organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. All entries become the sole and exclusive property of the Sponsor and receipt of entries will not be acknowledged or returned.
3. PRIVACY POLICY: The personal information submitted with your Entry will only be used by Sponsor, in accordance with Sponsor’s Privacy Policy. Please review the Sponsor’s Privacy Policy at http://benihana.com/privacypolicy.asp. By participating in the Sweepstakes, entrants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s privacy policy.
4. SELECTION OF WINNERS: There will be one (1) drawing held each month. Winners will be selected from eligible entries received on or about the first of each month beginning in July 2009. Decisions of judges are final on all matters. Winners will be notified by e-mail. Limit one prize per person/household address. Odds of winning will depend upon the number of eligible entries received in the Benihana Memories Drawing.
Each month, we’ll select three (3) winners who will receive a $50 Benihana gift card. In addition, winning photos will be posted on our website. By submitting an entry, participants grant Benihana National Corp. permission to use name, story and photographic likeness in all promotional and publicity materials, including but not limited to newspaper, magazines, internet and company newsletter.
5. GENERAL CONDITIONS: All federal, state and local taxes are the sole responsibility of winners. All federal, state and local laws and regulations apply. Potential winners (or parent/legal guardian if potential winner is a minor in his/her state of residence) may be required to sign and return an Affidavit of Eligibility/Release of Liability/Prize Acceptance Form postmarked within 10 days of the date on notification materials. Noncompliance within this time period may result in disqualification and an alternate potential winner may be selected. If any winner cannot be contacted within five (5) calendar days of first notification attempt, if any prize or prize notification is returned as undeliverable, if any winner rejects his/her prize or in the event of noncompliance with these Sweepstakes rules and requirements, such prize will be forfeited and an alternate winner will be selected from all remaining eligible entries. Upon prize forfeiture, no compensation will be given. Acceptance of any prize constitutes permission to the Sponsor to use winners’ name, voice, statements, image and likeness for purposes of advertising and trade, in any medium, without further compensation, unless prohibited by law.
6. RELEASE OF LIABILITY: Sponsor not responsible for any typographical or other error in the printing, the offering or the announcement of any prize or in the administration of the promotion, whether caused by computer, technical or human error. By participating, entrants and winners agree to release and hold harmless Sponsor, its advertising and promotion agencies and their respective parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors, from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death which may occur in connection with, preparation for, travel to, or participation in Sweepstakes, or possession, acceptance and/or use or misuse of prize or participation in any Sweepstakes-related activity and for any claims based on publicity rights, defamation or invasion of privacy and merchandise delivery. Sponsor is not responsible if Sweepstakes cannot take place or if any prize cannot be awarded due to travel cancellations, delays or interruptions due to acts of God, acts of war, natural disasters, weather or acts of terrorism. Sponsor is not responsible for late, lost, damaged, incomplete, illegible, faulty, or incorrect transmissions, incorrect announcements of any kind, technical hardware or software failures of any kind, any damage to any person's computer related to or resulting from participating in the online portion of the promotion, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmission that may limit a user’s ability to participate in the sweepstakes whether caused by computer, technical or human error. Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, extend or suspend this Sweepstakes should (in its sole discretion) virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes. In such case, Sponsor will select the winners from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. Entrants who do not comply with these Official Rules, or attempt to interfere with this Sweepstakes in any way shall be disqualified. Sponsor reserves the right to disqualify, freeze or prohibit the participation of an individual if fraud or tampering is suspected, or if the individual fails to comply with any requirement of participation or with any provision in these Official Rules.
